Texas law defines an assault as “performing an intentional act that gives another cause to think you are about to cause physical harm.” You do not have to actually touch a person or cause any harm, as long as you have actually threatened someone in a way that has caused them to fear you will harm them.

Penalties for assault depend on the circumstances of the assault and whether you have any prior misdemeanor or felony convictions. An assault can be charged as a Class C misdemeanor carrying a penalty of a fine of up to $500 with no jail time, or up to a Third Degree Felony, carrying a sentence of up to 10 years in prison and a fine of up to $10,000. The penalty is increased if the person assaulted is a government worker, law enforcement officer, emergency worker or security guard and the assault occurred while they were doing their jobs.
