Employment Visas

Any person who is not a U.S. citizen or a permanent legal resident with a Green Card and who wants to be employed in the U.S. must obtain an appropriate visa. There are various types of visas and each one has a list of eligibility requirements and individual qualifications.

Common Types of Work Visas

An overview of the most common employment-based visas includes employment for:

• Exchange visitor programs (J non-immigrant visa). This is for people who are coming to the U.S. for a specific purpose and who are approved to work in jobs such as camp counselor, au pair, physicians, scholars, interns, and teachers.
• Temporary non-agricultural workers (H-2B visa). There are only 66,000 visas in this category and often go to workers in ski resorts, hotels, beach resorts, or amusement parks.
• Temporary workers who are skilled (H1-B non-immigrant visa). This allows a foreign, non-immigrant worker to work for a specific employer because the worker has specific skills.
• Seasonal agricultural workers (H2-A). Visas in this category are only issued if there is a shortage of U.S. citizen workers to do these jobs.
