Wrongful Death

Texas law allows certain family members to file a wrongful death claim against the party whose negligence was responsible for the death. Those who are authorized by statute to file a lawsuit are:

If none of these people file a claim within three months of the death, the personal representative of the decedent’s estate may file a claim. In Texas, siblings cannot bring a wrongful death claim no matter how much they grieve the loss of their brother or sister.
