    What is a Personal Injury Claim?

    A personal injury claim is just the beginning of a personal injury lawsuit. A claim is your official request for compensation with the insurance company of the entity responsible for your injury, which is lodged with the insurer and claims adjuster will be assigned to your case.

The adjuster works for the insurance company and their job is to save their employer as much money as possible, which means convincing you to accept a minimal amount of compensation for your injury, pain, and suffering.     Filing Lawsuit in a Texas Court

    If the claim cannot be settled out of court, Texas state law requires you to file your lawsuit within two years of the date of the accident. Negotiations can continue after you file the lawsuit, but if you miss the filing deadline, you lose forever your right to file a lawsuit.

    Texas law requires you to prove who was at fault for the accident. If you were partially at fault for the accident, under Texas’ Proportionate Responsibility statute, your recoverable damages will be reduced by whatever percent the court finds you were at fault for the accident. If you were 50 percent or more at fault for the accident, you will be precluded from collecting any damages at all.
